Njoftimi i vendimit të gjykatës
Vendimi i gjykatës mbi kërkesën për ndihmë juridike dytësore i njoftohet menjëherë:
a) kërkuesit;
b) personit që ka dorëzuar kërkesën për ndihmë juridike dytësore, në rast se është një person i ndryshëm nga kërkuesi;
c) organit procedues, nëse janë kushtet e nenit 21 të këtij ligji;
ç) Drejtorisë së Ndihmës Juridike Falas;
d) dhomës vendore të avokatisë, në rast se kërkesa për ndihmë juridike dytësore është miratuar.
Neni i mësipërm përcakton se kujt i njoftohet vendimi i gjykatës për miratimin ose refuzimin e kërkesës për dhënien e ndihmës juridike dytësore. Njoftimi i vendimit kryhet në përputhje me procedurën dhe me formën e përcaktuar në Kodin e Procedurës Civile.
Neni përcakton në fjalinë e parë të tij fjalën “menjëherë” dhe nuk përcakton nëse vendimi i gjykatës që njoftohet duhet të jetë i formë së prerë apo jo, pra është kaluar afati i ankimit ndaj tij dhe për të nuk është ushtruar ankim, psh nga Drejtoria e Ndihmës Juridike Falas, apo Gjykata e Apelit, në rast ankimi, ka lënë në fuqi apo ndryshuar vendimin e gjykatës së shkallës së parë. “Interesat” e të njoftuarve për vendimin e gjykatës në lidhje me kërkesën për ndihmën juridike në këtë aspekt janë të ndryshme. Psh Drejtoria e Ndihmës Juridike Falas duhet të njoftohet menjëherë në mënyrë që të ketë mundësinë të ushtrojë ankim sipas përcaktimit të bërë në nenin 22 të ligjit. Ndërkohë, dhoma vendore e avokatisë për interesin e zhvillimit të procedurës së saj e ka të domosdoshme të marrë vendimin në formë të prerë të gjykatës.
Në këtë këndvështrim me akt nënligjor të Ministrit të Drejtësisë është e nevojshme të përcaktohet ose njoftimi të bëhet dy herë, një herë pasi gjykata jep vendimin dhe herën e dytë kur vendimi i gjykatës merr formë të prerë, ose të bëhet një katëgorizim i njoftuesve, dmth atyre të njoftuarve që i dërgohet vendimi i gjykatës menjëherë pas marrjes së tij dhe vendimi i gjykatës kur ky i fundit merr formë të prerë.
Nga ana tjetër, fakti që vendimi gjyqësor i dërgohet subjekteve të cituara në këtë nen nuk do të thotë që ata kanë një pozitë procedurale në procesin gjyqësor, pra, ata duhet të jenë palë ose duhet ftohen të jenë palë në procesin gjyqësor. Palë në procesin gjyqësor është vetëm kërkuesi për përfitimin e ndihmës juridike dytësore, ndërsa të gjithë subjekteve të tjera vendimi gjyqësor i njoftohet.
