Detyrat e Dhomës Kombëtare të Avokatisë
Dhoma Kombëtare e Avokatisë kryen këto detyra:
miraton me udhëzim të përbashkët me Drejtorinë e Ndihmës Juridike Falas kriteret dhe procedurat
për përzgjedhjen e avokatëve që ofrojnë shërbimet e ndihmës juridike dytësore;
b) miraton, në bashkëpunim me Ministrinë e Drejtësisë, rregullat për zbatimin e parimit të rotacionit në caktimin e avokatëve që ofrojnë shërbime të ndihmës juridike dytësore, sipas parashikimeve të nenit 24, të këtij ligji, dhe mbikëqyr zbatimin e tyre nga dhomat vendore të avokatisë;
c) brenda datës 1 shkurt të çdo viti kalendarik, Dhoma Kombëtare e Avokatisë miraton listën e avokatëve që ofrojnë shërbimet e ndihmës juridike dytësore dhe ia përcjell këtë listë Ministrisë së Drejtësisë, Drejtorisë së Ndihmës Juridike Falas dhe dhomave vendore të avokatisë. Në hartimin e kësaj liste, Dhoma Kombëtare e Avokatisë mban parasysh, për aq sa është e mundur, përfshirjen e avokatëve të të gjitha specialiteteve dhe niveleve dhe respektimin e barazisë gjinore;
ç) publikon listën e avokatëve që ofrojnë shërbimet e ndihmës juridike dytësore në faqen zyrtare të Dhomës Kombëtare të Avokatisë;
d) përgatit dhe organizon programet e trajnimit të vazhdueshëm për avokatët e përfshirë në listën e avokatëve që ofrojnë shërbimet e ndihmës juridike dytësore, në bashkëpunim me Drejtorinë e Ndihmës Juridike Falas;
dh) kryen detyra të tjera që i caktohen nga ky ligj.
Parashikimet e këtij neni 9 të Ligjit nr. 111/2017 janë të qarta në lidhje me detyrimin e përfshirjes së Dhomës Kombëtare të Avokatisë në ndihmën juridike dytësore. Pra, ndihma juridike parësore nuk është në fokusin e detyrave të Dhomës Kombëtare të Avokatisë.
Ky nen lexohet që ai përcakton jo vetëm detyrat e Dhomës Kombëtare të Avokatisë në fushën e ndihmës juridike, por edhe përcakton disa nga aktet nënligjore të cilat duhet të miratohen në bashkëpunim me Ministrinë e Drejtësisë. Dhoma Kombëtare e Avokatisë, që merr pjesë në përcaktimin e kritereve për përzgjedhjen e avokatëve, që japin ndihmën juridike falas dhe specializimin e tyre në fushat përkatëse sipas kërkesave ligjore, merr pjesë në përcaktimin e kritereve për vlerësimin e cilësisë së shërbimit të dhënë nga avokatët, merr masa disiplinore ndaj avokatëve, që ofrojnë ndihmë juridike falas, etj[1].
Kriteret dhe procedurat për përzgjedhjen e avokatëve që ofrojnë shërbimet e ndihmës juridike dytësore, sipas gërmës ‘a’ të nenit 9 të Ligjit nr. 111/2017, duhet të orientohen mbi të gjitha nga parimi i cilësisë së shërbimit të ndihmës juridike dhe profesionalizmit të ofruesve të këtij shërbimi në funksion të aksesit efektiv të individit në drejtësi. Kriteret përkatëse duhet të jenë objektive sa më shumë që të jetë e mundur, duhet të jenë të mirëpërcaktuara dhe shteruese, në mënyrë që gjatë procesit të përzgjedhjes së avokatëve të ketë sa më pak mundësi subjektivizmi. Pa anashkaluar kriteret e nenit 24 ‘Dhënia e ndihmës juridike dytësore nga avokatët’ pika 1 tё Ligjit nr. 111/2017[2], kritere objektive, të tilla si, pasja e licencës së avokatit të lëshuar rregullisht nga Dhoma Kombëtare e Avokatisë, kohëzgjatja në profesionin e avokatit, kohëzgjatja në dhënien e ndihmes juridike falas, një numër i caktuar për çdo fushë të së drejtës por, gjithnjë duke mbajtur parasysh se në cilat fusha mund të jepet ndihma juridike falas, numër i përcaktuar duke zbatuar barazinë gjinore, duhet të drejtojnë përzgjedhjen e avokatëve të cilët do të kontraktohen për të dhënë ndihmë juridike falas. Duhet kuptuar që jo çdo avokat i licencuar për të ushtruar profesionin në Republikën e Shqipërisë mund të përzgjidhet për të dhënë ndihmë juridike falas; vetëm ata të cilët do të plotësojnë kriteret objektive të mirëpërcaktuara dhe shteruese në udhëzimin e përbashkët të parashikuar në nenin 9 gërma ‘a’ të Ligjit nr.111/2017, do të përzgjidhen të ofrojnë shërbimet e ndihmës juridike dytësore. Në përzgjedhjen e avokatit për të dhënë ndihmë juridike falas, duhet konsideruar edhe nëse avokati ka përmbushur detyrën sipas neni 8 gërma 'f' të Ligjit për Ushtrimin e Profesionit të Avokatit në Republikën e Shqipërisë i cili parashikon shprehimisht se avokati “f) merr masat e nevojshme në lidhje me sigurimin e përgjegjësisë profesionale, sipas rregullave të përcaktuara në Statutin e Dhomës së Avokatisë të Shqipërisë”. Zbatimi i këtij kriteri do të ishte një garanci shtesë për sigurimin në mënyrë efektive të cilësisë dhe profesionalizmit gjatë dhënies së ndihmës juridike falas.
Në lidhje me këtë detyrë të Dhomës Kombëtare të Avokatisë, udhëzimi i përbashkët të lexohet në mënyrë të tillë që të mundësohet që në vitet e para të zbatimit të Ligjit nr. 111/2017 e derisa të krijohen kapacitet përkatëse, në rrethe të tjera avokatësh nëpërmjet trajnimeve të specializuara, etj., të përzgjidhen avokatë të cilët që nga viti 1990 kanë dhënë shërbimin e ndihmës juridike falas, përfshirë këtu si avokatët në profesion të lirë që kanë punuar me ndihmën juridike kryesisht, ashtu edhe avokatët të kontraktuar nga operatorët joqeveritarë të ndihmës juridike falas. Sa më sipër, është në funksion të cilësisë së dhënies së ndihmës juridike falas për akses efektiv.
Sipas përcaktimit përkatës të Ligjit nr. 111/2017, kriteret dhe procedurat për përzgjedhjen e avokatëve miratohen me udhëzim të përbashkët të Drejtorisë së Ndihmës Juridike Falas dhe Dhomës Kombëtare të Avokatisë[3].
Për sa ka të bëjё me detyrat e përcaktuara për Dhomën Kombëtare të Avokatisë në pikat ‘b’ dhe ‘c’ të këtij neni, në lidhje me emërimin e avokatëve në listën për dhënien e ndihmës juridike kemi konkurrim të parimit të rotacionit me parimin e cilësisë dhe profesionalizmit në dhënien e ndihmës juridike falas. Parimi i rotacionit siguron transparencën dhe barazinë në kontraktimin e avokatëve të cilët paguhen me fonde shtetërore. Pavarësisht nga kjo, në kushtet që mbizotëron parimi i cilësisë dhe profesionalizmit në dhënien e ndihmës juridike në funksion të përmirësimit të funksionimit të sistemit të drejtësisë dhe mbrojtjes efektive të të drejtave ligjore dhe kushtetuese të individit, gjatë miratimit të listave vjetore, është e rëndësishme që Dhoma e Avokatisë të mbajë në vëmendje, si fushën e së drejtës për të cilën është i specializuar avokati përkatës, ashtu edhe cilësinë e formimit profesional të tij/saj.
Në lidhje me gërmën ‘d’ të nenit 9 të Ligjit nr. 111/2017, vëmendje duhet kushtuar në detyrën e dhomave vendore të avokatisë për të monitoruar zbatimin e parimit të rotacionit sipas parashikimeve të nenit 24 të Ligjit 111/2017[4]. Është e vetkuptueshme që kjo detyrë duhet lexuar në lidhje me të drejtat, detyrimet dhe përgjegjësitë e dhomave vendore të avokatisë të përcaktuara në Ligjin për profesionin e avokatit në Republikën e Shqipërisë. Legjitimimi i procedimit disiplinor mund të bazohet edhe në rastet e moszbatimit të detyrimeve për dhënien e ndihmës juridike kur avokati përcaktohet në bazë të parimit të rotacionit.
Detyrimi për përgatitjen e listës së avokatëve rrjedh edhe nga neni 28 gërma ‘e’ dhe ‘ë’ e Ligjit nr. 55/2018 “Për profesionin e avokatit në Republikën e Shqipërisë” të cilat parashikojnë respektivisht dhe shprehimisht se Komiteti Drejtues i Dhomës Kombëtare të Avokatisë“, e) çdo fillim viti përgatit listën e mbrojtësve, në rastin e dhënies së mbrojtjes së detyrueshme, dhe ia vë në dispozicion organit procedues, në përputhje me parashikimet e Kodit të Procedurës Penale, ë) përgatit listën e avokatëve që ofrojnë shërbimet e ndihmës juridike dytësore, sipas legjislacionit në fuqi për ndihmën juridike të garantuar nga shteti; ...”. Parimi i rotacionit në përzgjedhjen e avokatëve është risia që sjell në këtë aspekt Ligji nr. 111/2017.
Në lidhje me gërmën ‘e’ të nenit 28 të Ligjit 111/2017, është e rëndësishme të kujtojmë që objekt i këtij ligji është “Ndihmë juridike dytësore”, pra, edhe shërbimi juridik që ofrohet në çështjet penale, për të cilat nuk zbatohet mbrojtja e detyrueshme, sipas përcaktimeve të legjislacionit procedural penal.
Procesi i emërimit të avokatëve, publikimi i listës përkatëse, mënyra dhe procedura se si individët kërkues të ndihmës juridike falas vihen në dijeni të listës dhe se si mund të vendosin marrëdhënien e drejtpërdrejtë avokat me klient, pavarësisht se avokatët financohet nga shteti dhe për klientet përkatës shërbimi i ndihmës ligjore është falas, e të tjera aspekte që ndikojnë në këtë marrëdhënie, etj., duhet të jenë të qarta, por edhe të krijojnë eficience kohore dhe financiare, si dhe potencialin për maksimizimin e cilësisë dhe profesionalizmit të shërbimit ligjor gjatë dhënies së ndihmës juridike falas[5]. Drejtoria e Ndihmës Juridike Falas bën përpjekjet maksimale në kuadrin ligjor ekzistues që të përqëndrojë këtë proces para publikut mundësisht vetëm në një institucion të vetëm për të lehtësuar aksesin e kërkesve përkatës në ndihmën juridike falas. Parashikimet e Ligjit nr. 111/2017, kanë parashikuar detyrime të ndryshme për Ministrinë e Drejtësisë, gjykatat dhe Dhomën Kombëtare të Avokatisë (apo dhomat vendore të avokatisë)[6] në përballjen me kërkuesit e ndihmës juridike falas dhe, në këto kushte, Drejtoria e Ndihmës Juridike Falas, nëpërmjet portaleve online të integruara, të krijojë sistem të njëjtë ‘one stop shop’ për të shmangur vështirësitë në aksesin e kërkuesve në ndihmën juridike falas, por edhe për të maksimizuar efiçiencën financiare dhe kohore të proceseve përkatëse.
Detyra e Dhomës Kombëtare të Avokatisë sipas përcaktimit të nenit 9 germa ‘d’ të Ligjit nr. 111/2017, “d) përgatit dhe organizon programet e trajnimit të vazhdueshëm për avokatët e përfshirë në listën e avokatëve që ofrojnë shërbimet e ndihmës juridike dytësore, në bashkëpunim me Drejtorinë e Ndihmës Juridike Falas;...”, duhet pare e lidhur me detyrat e Dhomës Kombëtare të Avokatisë për trajnimin e vazhduar të avokatëve nëpërmjet Shkollës së Avokatisë. Shih neni 54 i Ligjit nr. 55/2018 “Për profesionin e avokatit’ i cili parashikon: “3. Avokatët që do të përfshihen në listën e Dhomës së Avokatisë të Shqipërisë për ofrimin e shërbimeve të ndihmës juridike dytësore, kryejnë trajnim specifik mbi fusha të së drejtës të lidhura me kategoritë përfituese të ndihmës juridike dytësore, sipas legjislacionit në fuqi për ndihmën juridike të garantuar nga shteti.” Pra, neni 9 i Ligjit nr. 111/2017 ka të bëjë me trajnimin e vazhduar të specializuar në fushën e ndihmës juridike të atyre avokatëve të cilët përzgjidhen për të dhënë ndihmën juridike falas sipas udhëzimit të përbashkët të Drejtorisë së Ndihmës Juridike Falas dhe Dhomës Kombëtare të Avokatisë, parashikuar në gërmën ‘a’ të nenit 9 të Ligjit nr. 111/2017.
