Dhënia e ndihmës juridike dytësore

Neni:

Ndihma juridike dytësore jepet nga avokatët që përfshihen në listën e miratuar nga Dhoma Kombëtare e Avokatisë, në bazë të kërkesës së personit që gëzon të drejtën për përfitimin e ndihmës juridike dytësore, sipas neneve 11 ose 12, të këtij ligji. Kërkesa hartohet sipas formularit të kërkesës, të miratuar nga Ministri i Drejtësisë.

Sipas këtij neni vetëm avokatët mund të japin ndihmën dytësore pra shërbimin juridik për përpilimin e akteve për të vënë në lëvizje gjykatën; ofrimin e këshillimit, përfaqësimit dhe mbrojtjes para gjykatës në çështjet administrative, civile dhe në çështjet penale.

Dhoma e Avokatisë së Shqipërisë ka detyrimin ligjor të hartimit dhe miratimit të listave të avokatëve për ofrimin e ndihmës juridike dytësore. Dhoma e Avokatisë së Shqipërisë kërkon fillimisht nga avokatët apo studiot e avokatisë, të paraqesin pranë saj shprehjen e interesit për ofrimin e një shërbimi të tillë. Kërkesa hartohet sipas formularit që shoqëron njoftimin dhe është e ndarë sipas specialiteteve. Çdo subjekt që shpreh interesin për ofrimin e ndihmës juridike ka të drejtë të zgjedhë pa kufizime kandidimin në specialitet si më poshtë:

e drejta civile
e drejta penale
e drejta administrative
drejtësia penale për të mitur.

Tek kjo e fundit vetëm avokatët që janë duke u trajnuar në këtë fushë dhe që i plotësojnë kushtet për certifikim për këtë qëllim.

Aplikantët për kandidim, bashkë me formularin mund të paraqesin edhe dokumenta shtesë të specializimit në fushën që ata kërkojnë. Bashkë me dokumentat e mësipërme duhet të depozitohet edhe vërtetim që vërteton se aplikanti nuk ka detyrime tatimore, së bashku me deklaratë personale të gjendjes gjyqësore.

Dhënia e ndihmës juridike është e veçantë për çdo dhomë vendore avokatie dhe, për këtë shkak, aplikimi bëhet për çdo dhomë vendore. Nuk lejohet që një avokat i cili nuk është antar i një dhome vendore avokatie, të aplikojë pranë kësaj dhome për ofrimin e ndihmës juridike.

Sipas përcaktimeve të bëra në Kodin e Procedurës Penale mbrojtja e të pandehurit bëhet vetëm nëpërmjet avokatit (mbrojtësit për terminologjinë e përdorur në të), ndërkohë në Kodin e Procedurës Civile (neni 96), përfaqësuesi avokat i palës është vetëm një prej kategorive që realizojnë përfaqësimin ne një gjyq civil. I njëjti zbatim si në Kodin e Procedurës Civile zbatohet edhe në rastin e gjykimit administrativ.

Sipas nenit 20 të ligjit nr. 55/2018 “Për profesionin e avokatit në Republikën e Shqipërisë” të gjithë kandidatët për avokat, që plotësojnë kushtet e parashikuara në shkronjat “a”, “b”, “d” dhe “dh”, të pikës 2, të nenit 13, të këtij ligji, kanë të drejtë të regjistrohen pranë Dhomës së Avokatisë të Shqipërisë për të kryer stazhin 1-vjeçar të kandidatit për avokat. …. Kandidati për avokat ka të drejtë të përfaqësojë ose të mbrojë klientin në fazën hetimore, në gjykimin e kundërvajtjeve penale, me autorizimin dhe praninë e avokatit, si dhe kurdoherë me pëlqimin me shkrim të klientit.

A mundet që një kandidat për avokat të ofrojë ndihmën juridike dytësore? Pavarësisht përcaktimeve që ka bërë ligji për profesionin e avokatit duke mundësuar për kandidatët për avokat që të mbrojnë një person në fazat hetimore apo gjykimin e kundërvajtejeve penale, (në praninë e avokatit), ata përderisa formalisht nuk kanë titullin avokat nuk mund ta ushtrojnë apo ofrojnë dhënien e ndihmës juridike dytësore sipas ligjit “Për ndihmën juridike të garantuar nga shteti”.

Në zbatim të detyrimeve të përcaktuara në këtë nen është miratuar nga Ministri i Drejtësisë edhe akti nënligjor, sipas formatit që i bashkëlidhet këtij Komentari. Teksti i këtij Formulari përmban pyetje dhe kërkon të dhëna, që duke mbajtur parasysh edhe nivelin e personave që përfitojnë këtë lloj ndihme juridike, janë në pamundësi ta plotësojnë atë siç duhet. Për këtë gjë ata kanë nevojë për asistencë, e cila rezulton se mund të jepet nga ofruesit e shërbimit të ndihmës juridike parësore, përderisa ne fund të formularit edhe ata duhet të nënshkruajnë atë. Gjithsesi, nënshkrimi i këtij të fundit në Formular nuk është domosdoshmëri juridike. Një person që paraqet kërkesën për ndihëm juridike dytësore mund ta plotësojë dhe nënshkruajë edhe vetëm Formularin dhe ta paraqesë atë personalisht ose me postë në gjykatë. Për pasojë, nënshkrimi i Formularit edhe nga ana e punonjësit të ndihmës juridike parësore nuk përbën kusht të domosdoshëm për fillimin e shqyrtimit të saj nga gjykata.
