Dhënia e ndihmës juridike parësore nga organizatat jofitimprurëse
Organizatat jofitimprurëse japin shërbime të ndihmës juridike parësore në përputhje me autorizimin e miratuar nga Ministri i Drejtësisë. Procedurat dhe dokumentacioni për autorizimin e tyre përcaktohen me vendim të Këshillit të Ministrave.
Organizatat jofitimprurëse që autorizohen për dhënien e shërbimeve të ndihmës juridike parësore duhet të përmbushin këto kritere:
të jenë të regjistruara në përputhje me legjislacionin në fuqi për organizatat jofitimprurëse;
të kenë si objekt të veprimtarisë së tyre të parashikuar në statutin e organizatës ofrimin e shërbimeve të ndihmës juridike;
të kenë shlyer detyrimet tatimore në përputhje me legjislacionin në fuqi;
ç) të kenë përvojë në ofrimin e ndihmës juridike;
d) të mos jenë në proces falimentimi dhe/ose likuidimi;
dh) anëtarët e organit më të lartë vendimmarrës dhe të organit ekzekutiv të organizatës jofitimprurëse të mos jenë dënuar me vendim gjyqësor të formës së prerë për kryerjen e një vepre penale me dashje dhe që do të cenonte besimin e publikut dhe ofrimin e përshtatshëm të ndihmës juridike.
3. Organizatat jofitimprurëse të autorizuara për dhënien e ndihmës juridike parësore përfitojnë financime nga buxheti i shtetit, pas një procesi konkurrues dhe transparent përzgjedhjeje. Procedura, rregullat e përzgjedhjes së organizatave jofitimprurëse të autorizuara, që përfitojnë financime nga buxheti i shtetit dhe mënyra e financimit të tyre përcaktohen me vendim të Këshillit të Ministrave.
Në këtë nen rregullohet, mbi të gjitha, ofrimi i ndihmës juridike parësore nga organizatat jofitimprurëse si operatorë të ndihmës juridike parësore. Fokusimi i punës së organizatave jo-fitimprurëse në ndihmën juridike parësore është risi e këtij ligji, nëse kuptojmë që me organizata jofitimprurëse që plotësojnë kriteret për ndihmën juridike parësore Ligji nr. 111/2017 nuk kupton organizatat jofitimprurëse të cilat nëpërmjet avokatëve të punësuar apo të kontraktuar me kontratë shërbimi japin shërbime ligjore, pra, shërbime të ndihmës juridike dytësore për publikun. Regjimi i këtyre të fundit në lidhje me ndihmën juridike dytësore rregullohet sipas dispozitave të tjera të Ligjit nr. 111/2017 dhe akteve përkatëse nënligjore që kanë të bëjnë me ndihmën juridike dytësore, si dhe dispozitat e tjera ligjore të legjislacionit shqiptar që kanë të bëjnë me profesionin e avokatit.
Organizatat jofitimprurëse të krijuara dhe regjistruara sipas legjislacionit për organizatat jofitimprurëse, të cilat kanë në objektin e veprimtarisë së regjistruar ofrimin e ndihmës juridike parësore, të autorizuara rregullisht nga ana e Ministrit të Drejtësisë, janë parashikuar nga ana e Ligjit nr. 111/2017 si subjekte për të ofruar shërbime të ndihmës juridike parësore. Organizatat jofitimprurëse japin shërbime të ndihmës juridike parësore në përputhje me autorizimin e miratuar nga Ministri i Drejtësisë. Procedurat dhe dokumentacioni për autorizimin e tyre përcaktohen me vendim të Këshillit të Ministrave. Organizatat jofitimprurëse të autorizuara për dhënien e ndihmës juridike parësore përfitojnë financime nga buxheti i shtetit, pas një procesi konkurrues dhe transparent përzgjedhjeje. Procedura, rregullat e përzgjedhjes së organizatave jofitimprurëse të autorizuara, që ofrojnë ndihmë juridike parësore dhe ato që përfitojnë financime nga buxheti i shtetit për ndihmën juridike parësore dhe mënyra e financimit të tyre janë përcaktuar me vendim të Këshillit të Ministrave (neni 15/1 dhe 15/3 i Ligjit nr. 111/2017).
Për qëllime të leximit dhe zbatimit të nenit 15 të Ligjit nr. 111/2017 mbajmë parasysh përkufizimin përkatës sipas nenit 3 gërma ‘b’ të Ligjit nr. 111/2017 për ndihmën juridike parësore[1], përmbajtje e autorizimit përkatës të lëshuar nga Ministri i Drejtësisë, si edhe disa orientime të dhëna në këtë Komentar në lidhje me ndihmën juridike parësore. Ky do të jetë objekti i veprimtarisë së këtyre organizatave në lidhje me llojin e shërbimeve të ndihmës juridike parësore. Objekti duhet përcaktuar qartë edhe duke iu referuar përkufizimit të ndihmës juridike dytësore në kushtet që neni 3 gërma ‘b’ e Ligjit 111/2017 përfshin edhe pikën e cila parashikon “vi) dhënia e të gjitha formave të tjera të mbështetjes së nevojshme juridike që nuk përbëjnë ndihmë juridike dytësore”. Në lidhje me fushat e së drejtës që do të mbulojë organizata përkatëse, lutem shih më poshtë në këtë seksion të Komentarit.
Aktet nënligjore në vijim, si (i) Vendimi nr.55, datë 06.02.2019 “Për përcaktimin e procedurave dhe dokumentacionin për autorizimin e organizatave jofitimprurëse, që ofrojnë ndihmë juridike parësore të garantuar nga shteti”, (ii) Vendimi nr.110, datë 6.3.2019 “Për përcaktimin e procedurave dhe rregullave të përzgjedhjes së organizatave jofitimprurëse, të autorizuara për ofrimin e ndihmës juridike parësore të garantuar nga shteti, që përfitojnë financime nga buxheti i shtetit”, dhe (iii) Urdhri nr.266 datë 25.3.2019 "Për Miratimin e Kontratave të Ndihmës Juridike të garantuara nga Shteti", janë të rëndësishëm në lidhje me nenin 15 të Ligjit. Me Urdhrin nr. 266 janë miratuar edhe dy kontratat tip me organizatat jofitimprurëse dhe avokatët përkatësisht për shërbimet e ndihmës juridike parësore dhe me avokatët për dhënien e shërbimeve të ndihmës juridike dytësore, në respektim të nenit 34, pika 2, të Ligjit nr. 111/2017.
Marrëdhënia midis organizatave jofitimprurëse dhe Drejtorisë së Ndihmës Juridike Falas do të rregullohet bazuar në kontratën standard tashmë të miratuar për ndihmën juridike parësore (shih Shtojcën 9 të këtij Komentari). Legjislacioni i miratuar deri në datën e këtij Komentari, nuk parashikon apo nuk përcakton shprehimisht mbi llojin e çështjeve apo fushave të së drejtës që duhet të mbulojnë organizatat jofitimprurëse gjatë ofrimit të ndihmës juridike parësore. Kjo do të përcaktohet në kontratën që do të nënshkruhet midis Drejtorisë së Ndihmës Juridike Falas dhe organizatës jofitimprurëse në rastet kur këto të fundit financohet nga fonde shtetërore. Deri më sot, organizatat jofitimprurëse kanë mbuluar çështje në lidhje me të drejtat e natyrës social-ekonomike, duke shtuar edhe ato të natyrës mjedisore, me impakt në të drejtën për kujdes shëndetësor, si fusha dhe veprimtaria më e gjerë që hulumtohet nga organizatat gjatë misionit dhe ushtrimit të veprimtarisë së tyre për dhënie ndihme juridike falas në format e parashikuara nga ligji dhe të emërtuara si shërbime paraligjore, forma këshillimi ose asistencë në institucionet e administratës publike. Anketimet dhe raportet përkatëse kanë treguar se nevojat për asistencë i përkasin kategorisë dhe legjislacionit që i përket garantimit të këtyre të drejtave[2].
Nëse i referohemi kontratës standard të miratuar vihet re se, gjatë negocimit midis palëve para nënshkrimit, kontrata standard duhet të pasurohet edhe me elementё të tjerë mbi detyrimet e organizatës, të lidhura me aspekte të tilla, si numri dhe niveli i stafit të organizatës që do të punojnë për dhënien e ndihmës ligjore, standarde në lidhje me mjediset ku do të jepet ndihma juridike e detyrime të tjera që i shërbejnë dhënies me cilësi, profesionalizëm, efektivitet dhe eficiencë dhe duke zbatuar parimet e tjera të dhënies së ndihmës juridike. Me rëndësi është të parashikohet në kontratë edhe mënyra e monitorimit dhe kontrollit të dhënies së ndihmës juridike parësore nga ana e Drejtorisë së Ndihmës Juridike Falas. Sigurisht disa elemente dhe informacione shkëmbehen zyrtarisht midis organizatës aplikante dhe Drejtorisë / Ministrit të Drejtësisë gjatë procesit të autorizimit të organizatës, por është e këshillueshme që detyrimet e organizatës gjatë kohëzgjatjes së kontratës të bëhen formalisht pjesë e kontratës që lidhet midis palëve. Në elementёt e tjerë që duhet të ketë kontrata janë, por pa u kufizuar në to, edhe parashikimi me hollësi i kthimit të përfitimeve të ndihmës ligjore, si dhe të njoftimit në kohë nga ana e organizatës në rastet kur do të tërhiqet nga ndihma juridike parësore.
Bazuar edhe në përvojën para miratimit të Ligjit nr. 111/2017, përgjithësisht, organizatat jo-fitimprurëse ofrojnë shërbime të ndihmës juridike parësore me mbështetjen financiare të donatorëve vendas dhe ndërkombëtarë. Keshtu, OSFA në bashkëpunim me Ministrinë e Drejtësisë ka mbeshtetur Zyrën e Ndihmës Ligjore Falas pranë Ministrisë së Drejtësisë, si dhe klinikat dhe qendrave e ligjit të cilat operojnë në Tiranë, Durrës, Shkodër, Vlorë, Elbasan, duke krijuar një rrjet zinxhir të ofrimit të ndihmës juridike falas në të gjithë rajonet kryesore të vendit.
Pavarësisht strategjisë që shteti do të ndjekë për të mundësuar funksionimin efektiv të organizatave që do të pranojnë mbështetje financiare nga buxheti shtetëror, në të njëjtën kohë është shumë e rëndësishme tё njihet dhe tё pranohet mbështetja që jep komuniteti i donatorëve për këto organizata si dhe vijueshmëria e kësaj mbështetje në plan afatgjatë. Kjo për qellime të garantimit të aksesit efektiv të individëve në skemën e ndihmës juridike falas parësore, akses i cila mundësohet kur ka mbështetjen e duhur me burime, përfshirë dhe pa u kufizuar edhe tek ato financiare.
Në aktet nënligjore përkatëse të miratuara tashmë, mbulohen çështje si më poshtë:
Vendimi nr. 55, datë 06.02.2019, parashikon rregulla të përgjithshme mbi kriteret ligjore që duhet të përmbushin organizatat jofitimprurëse, njoftimin për aplikim për autorizim, si edhe dokumentacioni që ato duhet të përmbushin në kuadër të ofrimit të shërbimit të ndihmës juridike parësore. Kjo VKM parashikon listën e dokumentacionit që duhet të paraqesin organizatat me qëllimin pajisjen e tyre me autorizim nga Ministri i Drejtësisë për ofrimin e ndihmës juridike parësore, si dhe procedurën për marrjen e autorizimit. Këto dokumente duhet të provojnë përmbushjen e kritereve profesionale dhe morale me qëllim që të kualifikohen për dhënien e ndihmës dhe vetëm ato organizata që garantojnë cilësi, profesionalizëm dhe reputacion të mirë në këtë fushë.
Pranimi i dokumentacionit, vlerësimi i përmbushjes së kushteve dhe verifikimi i dokumentacionit dhe relacioni përkatës, lidhur me secilën organizate aplikante përgatitet nga Drejtoria e Ndihmës Juridike, e cila ia përcjell për vendimmarrje Ministrit. Ministri bazuar mbi relacionin përkatës lëshon autorizimin, i cili është i vlefshëm për një periudhë 2 (dy) vjeçare. Në këtë VKM përcaktohet edhe mundësia që i ofrohet organizatave për plotësim dokumentacioni, kur konstatohet se pas dorëzimit ka mangësi, duke i lënë një afat prej 10 (dhjetë) ditësh. Vendimi parashikon se mossjellja e dokumentacionit plotësues brenda këtij afati passjell skualifikimin e organizatës aplikante për ndihmë juridike parësore. Në lidhje me plotësimin e kushtit të parashikuar nga gërma ‘d’ e nenit të Ligjit nr. 111/2017 që organizata aplikante “d) të mos jenë në proces falimentimi dhe/ose likujdimi”, për të shmangur çdo intepretim, qartësojmë që edhe organizatat jofitimprurëse të regjistruara në bazë të ligjit shqiptar mund të jenë subjekt i procedurave të likujdimit dhe falimentimit.
Në këtë VKM parashikohet se organizata jofitimprurëse aplikante ka të drejtën e ankimit brenda 5 (pesë) ditëve pranë Ministrit të Drejtësisë, për mosdhënien e autorizimit, duke paraqitur arsyet dhe dokumentacionin mbështetës. Ministri i Drejtësisë shqyrton ankesat dhe njofton organizatën jofitimprurëse lidhur me to brenda 10 (dhjetë) ditëve pune nga data e regjistrimit të ankimit pranë Ministrisë së Drejtësisë. Bazuar në këtë VKM, Ministria e Drejtësisë ka detyrimin të publikojë listën e organizatave jofitimprurëse të autorizuara.
Ministri i Drejtësisë, mund të revokojë autorizimin e dhënë një organizate joftimprurëse, kryesisht, apo bazuar në faktet e parashtruara në ankesat e paraqitura pranë Ministrisë së Drejtësisë dhe informacionet e Drejtorisë së Ndihmës Juridike, për mospërmbushjen në mënyrë të përsëritur të ofrimit të shërbimeve të ndihmës juridike parësore, në rast se janë paraqitur të dhëna të pasakta gjatë procesit të verifikimit të cilësisë së ofrimit të shërbimit të ndihmës juridike parësore, për mungesë të cilësisë së shërbimit të ndihmës juridike të ofruar, në rast se ndaj njërit prej anëtarëve të organit më të lartë vendimmarrës dhe të organit ekzekutiv të organizatës përkatëse është caktuar masa ndaluese apo është dhënë vendim dënimi i formës së prerë për kryerjen e një krimi, që cënon integritetin. Revokimi i autorizimit i njoftohet organizatës joftimprurëse përkatëse si dhe publikohet në faqen zyrtare të Drejtorisë së Ndihmës Juridike Falas. Kundër këtij vendimi mund të bëhet ankim në gjykatën administrative kompetente. Revokimi për mungesë të cilësisë në ofrimin e shërbimit të ndihmës juridike parësore është parashikuar në ligj si një mjet për të siguruar zbatimin e parimit të profesionalizmit, cilësisë, efektivitetit dhe efiçiencës gjatë dhënies së ndihmës juridike falas.
VKM nr.55 parashikon detyrimin që ka Drejtoria e Ndihmës Juridike Falas, për të hedhur në Regjistrin e Organizatave Jofitimprurëse që ofrojnë ndihmë juridike parësore, çdo të dhënë që lidhet me miratimin apo revokimin e autorizimit. Po kështu, në këtë VKM parashikohet detyrimi që ka organizata jofitimprurëse e autorizuar, që për arsye të caktuara dhe të justifikuara, ofrimi i shërbimit nga ana e saj bëhet i pamundur, duhet të njoftojë menjëherë Drejtorinë e Ndihmës Juridike Falas. Ky parashikim është bërë për të normuar rastet e veçanta dhe që Drejtoria e Ndihmës Juridike Falas të ketë mundësitë për të siguruar ofrim të pandërprerë për kërkuesit e ndihmës juridike.
Në VKM 110[3] në mënyrë të veçantë parashikohen parimet mbi bazën e të cilave bëhet përzgjedhja e organizatave të cilat përfitojnë financime nga shteti për dhënien e ndihmës juridike parësore. Procedurat e përfitimit të financimit të organizatave jofitimprurëse të autorizuara bëhen duke u bazuar në parimet e konkurrueshmërisë, trajtimit të barabartë dhe mosdiskriminimit të organizatave jofitimprurëse të autorizuara, aplikuese për përfitimin e financimit, transparencës në fazat që lidhen me shqyrtimin, vendimmarrjen dhe përzgjedhjen e organizatave jofitimprurëse të autorizuara, kritere të mirëpërcaktuara dhe publike të cilat do të mundësojnë vlerësimin e propozimeve të organizatave jofitimprurëse të autorizuara në raport me objektivat dhe prioritetet e mbështetjes financiare, efektivitetit dhe ekonomizimit në shfrytëzimin e fondeve publike duke siguruar që të arrihen objektivat dhe prioritetet e përcaktuara me një kosto sa më të favorshme për realizimin e shërbimit të synuar, respektimit të plotë të parimeve të llogaridhënies dhe raportimit në përdorimet e fondeve publike, financimit të shërbimeve të ndihmës juridike parësore për kategoritë e përfitueseve që janë me prioritet për Drejtorinë e Ndihmës Juridike Falas dhe në interes të përfituesve të ndihmës juridike parësore të garantuar nga shteti, ruajtjes së pavarësisë së organizatës jofitimprurëse të autorizuar, parandalimit të konfliktit të interesit, si dhe të çdo aktiviteti tjetër që rrezikon ofrimin me integritet të ndihmës juridike të garantuar nga shteti.
