Përfituesit e ndihmës juridike me të ardhura dhe pasuri të pamjaftueshme

Neni:

1. Të drejtën për të përfituar ndihmë juridike e ka çdokush që provon se ka të ardhura dhe pasuri të pamjaftueshme për të përballuar shpenzimet për këshillim, përfaqësim dhe/ose mbrojtje në çështjet penale, në çështjet administrative dhe në çështjet civile.

2. Të ardhurat e një personi, i cili jeton në një familje, konsiderohen të pamjaftueshme, sipas kuptimit të pikës 1, të këtij neni, nëse të ardhurat në total të të gjithë pjesëtarëve të familjes, të pjesëtuara për numrin e anëtarëve të familjes, janë më të ulëta se 50 për qind e pagës minimale mujore të përcaktuar sipas legjislacionit në fuqi.

3. Të ardhurat e një personi, i cili nuk jeton në një familje, konsiderohen të pamjaftueshme, sipas kuptimit të pikës 1, të këtij neni, nëse janë më të ulëta se niveli i pagës minimale mujore të përcaktuar sipas legjislacionit në fuqi.

4. Nëse një person, i cili jeton në një familje, kërkon ndihmë juridike dytësore për një çështje kundër një anëtari tjetër të së njëjtës familje, rregulli i parashikuar në pikën 2, të këtij neni, nuk do të zbatohet. Në këtë rast, të ardhurat e këtij personi konsiderohen të pamjaftueshme, sipas pikës 1, të këtij neni, nëse janë më të ulëta se niveli i pagës minimale të përcaktuar sipas legjislacionit në fuqi.

5. Pasuria e një personi konsiderohet e pamjaftueshme, sipas pikës 1, të këtij neni, nëse vlera e saj në total nuk tejkalon vlerën e 36 pagave minimale mujore sipas legjislacionit në fuqi.

Mbështetja me ndihmë juridike falas të përfituesve me të ardhura dhe pasuri të pamjaftueshme është parashikuar për të përmbushur nevojat e tyre për ndihmë juridike parësore dhe dytësore në çështjet penale, në çështjet administrative dhe në çështjet civile.

Mbështetja falas me ndihmë juridike rrjedh edhe si kërkesë e standardeve përkatëse ndërkombëtare. Një person ka të drejtën e ndihmës juridike falas nëse përmbushen dy kushte: së pari, nëse ai nuk ka mjete të mjaftueshme për të paguar ndihmën juridike dhe, së dyti, kur këtë gjë e kërkon Ligji. Këto dy kushte janë të përcaktuara në nenin 6 (3) (c) të KEDNJ-së[1] dhe nenin 14 (3) (d) të PNDCP[2].

Për të përcaktuar nëse një përfitues sipas këtij neni konsiderohet se plotëson kriterin objektiv të pamjaftueshmërisë së të ardhurave dhe të pasurive, skema e mbështetjes më ndihmë juridike ka marrë për referencë, pagën minimale mujore në shkallë vendi. Sipas legjislacionit përkatës në fuqi[3] në datën e publikimit të këtij Komentari, paga minimale mujore në shkallë vendi, sipas Vendimit nr. 809, datë 26.12.2018 “Për përcaktimin e pagesës minimale në shkallë vendi” është: “1. Paga bazë minimale mujore, për punonjësit, në shkallë vendi, që është e detyrueshme të zbatohet nga çdo person, juridik a fizik, vendës ose i huaj, të jetë 26 000 (njëzet e gjashtëmijë) lekë. 2. Paga bazë minimale mujore jepet për 174 orë pune në muaj, të kryera gjatë kohës normale të punës.”

Duhet mbajtur parasysh se paga minimale mujore në shkallë vendi ndryshon herë pas here, me vendim të Këshillit të Ministrave[4]. Llogaritja që bëhet nga ana e gjyqtarit, edhe nëpërmjet ekspertit, për të përkufizuar kërkuesin si "person me të ardhura të pakta ose të pamjaftueshme", është llogaritje matematikore financiare.

Në lidhje me standardet përkatëse, kujtojmë që sipas GJEDNJ, në parim, personave që u është mohuar ndihma falas, nuk u shkelet e drejta për akses sipas nenit 6, kur nuk bëjnë pjesë në kategoritë përfituese sipas skemës së përfitimit të sistemit ligjor vendas por, në raste përjashtimore, kjo lloj ndihme duhet të garantohet këtyre personave edhe jashtë skemës përfituese, kur thelbi i së drejtës për akses është cënuar (Miroslaw Orzechowski kundër Polonisë). Interesi i drejtësisë e kërkon që individit t’i garantohet ndihma juridike falas, nisur nga faktorë, si: rëndësia e çështjes për individin, kompleksiteti i çështjes, si dhe mungesa e kapacitetit të individit për të përfaqësuar veten e tij. Sipas detyrimit të zbatimit të drejtpërdrejtë të KEDNJ, gjyqtarët duhet të mbajnë në konsideratë, këtë jurisprudencë për interpretimin e së drejtës për akses, jo detyrimisht strictu sensu, sipas skemës financiare ligjore të sipërcituar. Fryma e interpretimit të skemës përfituese financiare ligjore, duhet të jetë që, e drejta për akses është dhënia e mundësisë faktike për akses, duke mos u cënuar thelbi i kësaj të drejte. Jurisprudenca përkatëse e GJEDNJ është në përputhje me përjashtimet që bën pika ‘f’ e këtij neni: Gjykata shprehet që ndihmat e shtetit nuk do të llogariten në të ardhurat e aplikantit, nëse aplikanti jeton vetëm me të ardhurat që i jep shteti; është detyrë e tij që t’i sigurojë ndihmë ligjore falas, përndryshe, do jetë shkelje e nenit 6/3 të KEDNJ.

Duke vazhduar me standardet ndërkombëtare përkatëse të cilat duhen zbatuar ose duhen ndjekur edhe për analogji gjatë krijimit të praktikave administrative apo gjyqësore përkatëse, vëmë në vëmendje se Direktiva 2002/8/EC, në nenin 5 ‘Kushtet në lidhje me burimet financiare’ parashikon se “1 1. Shtetet Anëtare mund të përcaktojnë kufijtë mbi të cilët parashtruesit e ndihmës juridike konsiderohen pjesërisht ose plotësisht në gjendje të përballojnë shpenzimet e procedurave të përcaktuara në nenin 3(2). Këto pragje përcaktohet në bazë të kritereve të përcaktuara në paragrafin 2 të këtij neni. 4. Pragjet e përcaktuara në paragrafin 3 të këtij neni nuk mund të parandalojnë aplikantët e ndihmës juridike që janë mbi pragjet e pranimit të ndihmës juridike, nëse vërtetojnë se nuk janë në gjendje të paguajnë koston e procedurave të përmendura në neni 3(2) si rezultat i ndryshimeve në koston e jetesës ndërmjet Shteteve Anëtare të vendbanimit të banimit ose të zakonshëm dhe të forumit. 5. Ndihma juridike nuk ka nevojë t'u jepet aplikantëve për aq kohë sa ata gëzojnë, në rastin konkret, qasje efektive në mekanizma të tjerë që mbulojnë koston e procedurave të përmendura në nenin 3(2)”.

Po kështu, në nenin 9 ‘Personat Vulnerabël’ të Direktivës 2016/1919 parashikohet shprehimisht se “Shtetet anëtare duhet të sigurojnë që nevojat e personave vulnerabël, që janë persona të akuzuar ose të kërkuar, të merren parasysh gjatë zbatimit të kësaj direktive”.

Në lidhje me provueshmërinë e faktit që personi aplikant për ndihmë juridike plotëson kushtet përkatëse (shih më sipër kushtet dhe kërkesat për përfituesit e ndihmës ligjore sipas këtij neni), kërkesa e ofruesit të ndihmës juridike për aktet përkatëse administrative, vendimet gjyqësore, dhe dokumentet e tjera përkatëse, legjitimohen nga nevoja për të provuar përmbushjen e kërkesave dhe kritereve ligjore të përzgjeshmërisë, krahas plotësimit të formularëve, etj., përkatës.
