Parimet e ndihmës juridike

Neni:

Dhënia e ndihmës juridike bazohet në parimet e mëposhtme:

a) aksesit të barabartë të individëve në ndihmën juridike;

b) barazisë dhe mosdiskriminimit të individëve që gëzojnë të drejtën për ndihmë juridike;

c) profesionalizmit në dhënien e shërbimit të ndihmës juridike;

ç) cilësisë, efiçencës dhe efikasitetit në kosto për shërbimet e ofruara të ndihmës juridike;

d) ruajtjes së konfidencialitetit;

dh) shmangies dhe parandalimit të konfliktit të interesit;

e) mbrojtjes së të drejtave të personave vulnerabël.

Parimet e parashikuara në këtë nen përbëjnë boshtin e të gjitha dispozitave të Ligjit nr. 111/2017 por, edhe të akteve nënligjore përkatëse të cilat janë miratuar tashmë. Respektimi i këtyre parimeve është i rëndësishëm për zbatimin e dispozitave të shprehura por, respektimi i tyre është i rëndësishëm edhe për qëllime të interpretimit dhe zbatimit të neneve të këtij ligji të cilat gjatë zbatimit praktik do të rezultojnë që nuk janë të shprehura në mënyrë literale qëndrime apo zgjidhje të ndryshme ligjore.

Në lidhje me parimet e parashikuara në këtë nen dhe për qëllime të ndihmës juridike dytësore, i referohemi edhe dispozitave përkatëse të Ligjit nr.55/2018 “Për profesionin e avokatit në Republikën e Shqipërise” i cili në nenin 8 ‘Detyrat e avokatit’, ndër të tjera, parashikon se avokati, gjatë ushtrimit të profesionit, “... d) ofron shërbime ndaj personave përfitues të ndihmës juridike falas, në përputhje me legjislacionin në fuqi për ndihmën juridike të garantuar nga shteti”. Ky parashikim krijon bazën ligjore për detyrueshmërinë e vënies në dispozicion të avokatëve për ndihmën juridike falas dhe të zbatimit të parimeve përkatëse, etj., të parashikuara në legjislacionin përkatës. E njëjta frymë ligjore rezulton edhe nga përmbajtja e nenit 14 të Ligjit nr. 55/2018 “Për Profesionin e Avokatit në Republikën e Shqipërisë”, sipas të cilit, një nga kushtet e ushtrimit të profesionit të avokatit është që avokati të zbatojë dispozitat ligjore dhe ato të parashikuara në Statutin e Dhomës së Avokatisë dhe në Kodin Etik të Avokatit.

Parimet e ndihmës juridike të radhitura në këtë nen janë në përputhje edhe me kërkesat përkatëse që burojnë nga KEDNJ dhe jurisprudenca e GJEDNJ, si dhe nga Direktivat përkatëse të BE.

a) Parimi i aksesit të barabartë të individëve në ndihmën juridike

Si duhet kuptuar aksesi i barabartë i individëve në ndihmën juridike? Aksesi i barabartë i individëve në ndihmën juridike do të thotë që nëse plotësohen kriteret objektive dhe kërkesat përkatëse të parashikuara në këtë ligj dhe në aktet përkatëse nënligjore, asnjë individi nuk mund t’i mohohet dhënia e ndihmës juridike përkatëse. Ky parim është i ndryshëm nga parimi i aksesit të barabartë në drejtësi por, është premisë themelore për aksesin e barabartë efektiv të individëve në drejtësi. Detyrimi i zbatimit të këtij parimi vjen edhe si detyrë e avokatit e parashikuar shprehimisht nga neni 8 gërma ‘b’ e Ligjit për Profesionin e Avokatit në Republikën e Shqipërisë[1]. Në lidhje me këtë, është përkatëse të kujtojmë se Kushtetuta e Republikës së Shqipërisë në nenin 18, pika 1, parashikon: “1. Të gjithë janë të barabartë përpara ligjit”. Për të qënë të barabartë përpara ligjit do të thotë edhe të kesh mundësi të barabarta për të aksesuar sistemin e drejtësisë.

b) Parimi i barazisë dhe mosdiskriminimit

Parimi i barazisë dhe mosdiskriminimit gjatë dhënies së ndihmës juridike bazohet dhe është në përputhje me parimin përkatës të parashikuar nga neni 18 i Kushtetutës së Republikës së Shqipërisë: “2. Askush nuk mund të diskriminohet padrejtësisht për shkaqe të tilla si gjinia, raca, feja, etnia, gjuha, bindjet politike, fetare a filozofike, gjendja ekonomike, arsimore, sociale ose përkatësia prindërore”. Leximi i këtij neni kushtetues orienton edhe për të kuptuar çfarë kupton dhënia e ndihmës juridike duke zbatuar parimin e barazisë dhe të mosdiskriminimit. Pra, askush nuk mund të diskriminohet në dhënien e ndihmës juridike, pavarësisht nga forma e saj, për shkak të gjinisë, racës, fesë, bindjeve politike, fetare a fiozofike, gjendjes ekonomike, arsimore, sociale apo përkatësia prindërore e kërkuesit të ndihmës. Në lidhje me gjendjen ekonomike të kërkuesit të ndihmës juridike, sigurisht parimi i barazisë dhe mosdiskriminimit zbatohet bazuar në kriteret e përzgjedhshmërisë mbi gjendjen ekonomike të kërkuesit, në rastet kur përfituesi nuk i takon grupeve të veçanta dhe përzgjedhshmëria bëhet vetëm mbi bazën e kritereve objektive të lidhura me gjendjen ekonomike të kërkuesit.

Bazuar në nenin 18, pika 3, e Kushtetutës e cila parashikon se askush nuk mund të diskriminohet për shkaqet e përmendura në paragrafin 2 të nenit 18 nëse nuk ekziston një përligje e arsyeshme dhe objektive, duket përkatëse të kujtohet se ndërsa ky nen shpreh në mënyrë absolute që askush nuk mund të diskriminohet për asnjë nga arsyet e përmendura në pikën 2 të nenit 18, ai legjitimon devijimin nga ky parim për shkaqe të ligjshme dhe objektive. Ky devijim për këto shkaqe legjimohet edhe gjatë dhënies së ndihmës juridike, nëse me shkaqe objektive kuptojmë zbatimin me përpikmëri të kritereve të përzgjedhshmërisë, dhe arsye të përligjshme ne konsiderojmë interesin publik sipas përkufizimeve përkatëse, gjendje të jashtëzakonshme, si dhe lejimin e ushtrimit të funksioneve ligjore të organeve shtetërore përkatëse.

Jurisprudenca e GJEDNJ në çështjen Tawalib kundër Greqisë orienton në lidhje me domosdoshmërinë e respektimit të parimit të mosdiskriminimit gjatë dhënies së ndihmës juridike. Ndërkohë, në çështjen Biba kundër Greqisë, GJEDNJ në vendimin përkatës shprehet se GJEDNJ ka konstatuar shkelje të KEDNJ kur shteti nuk i ka ofruar ndihmë juridike një të huaji dhe një emigranti, në kushtet kur të dy këta kërkues kishin mungesë të të ardhurave.

Në lidhje me parimin e mosdiskriminimit, vlen të përmendet që Direktiva 2002/8/EC në nenin 1 ‘Qëllimet dhe objektivat’ parashikon: “Qëllimi i kësaj direktive është të përmirësojë aksesin në drejtësi në mosmarrëveshjet ndërkufitare duke vendosur minimumin e rregullave të përbashkëta në lidhje me ndihmën juridike në mosmarrëveshje të tilla”. Po kështu, në lidhje me këtë parim, kujtojmë përmbajtjen edhe të nenit 4 ‘Mosdiskriminimi’: “Shtetet Anëtare do të japin ndihmë juridike pa diskriminim në Qytetarët e Unionit dhe shtetasit e vendeve të treta që banojnë në mënyrë të ligjshme në një shtet anëtar”.

c) Parimi i profesionalizmit në dhënien e shërbimit të ndihmës juridike

Në lidhje me këtë parim, është e rëndësishme të konsiderojmë edhe dallimin midis ndihmës juridike parësore dhe ndihmës juridike dytësore. Në kushtet që kërkesa për profesionalizëm për ndihmën juridike dytësore që ofrohet nga avokatët e licencuar rrjedhin, mbi të gjitha, nga Ligji për Profesionin e Avokatit në Republikën e Shqipërisë[2] (neni 8, gërma ‘a’ dhe ‘c’) dhe Kodi Etik i Avokatëve (neni 8, pika ‘c’), ky nen mund të lexohet si theksim për rëndësinë e zbatimit të këtij parimi, veçanërisht në lidhje me ndihmën juridike parësore. Sipas Ligjit nr. 55/2018, parimi i profesionalizmit kërkon që avokati të kryejë detyrën e tij të ndarë nga besimet apo paragjykimet e tij personale, të bëjë të gjitha përpjekjet e mundshme për të mbrojtur me efektivitet të drejtat dhe interesat e klientëve të tij.

Pa kundërshtuar sa më sipër, profesionalizëm është edhe ofrimi i ndihmës juridike në përputhje me ligjin material dhe procedural dhe standardet përkatëse sipas KEDNJ dhe jurisprudencës përkatëse të GJEDNJ. Specializimi i avokatëve dhe ofruesve të tjerë i shërben zbatimit të parimit të profesionalizmit në fushën e ndihmës juridike. Të gjithë operatorët e ofrimit të ndihmës juridike parësore, pa përjashtuar edhe avokatët, duhet të maksimizojnë përpjekjet për profesionalizëm në dhënien e ndihmës juridike, pra, të njohjes së ligjit material e procedural, të të drejtave përkatëse ligjore e kushtetuese, etj., në funksion të aksesit efektiv në drejtësi të kërkuesve të ndihmës juridike.

Në lidhje më këtë, është e rëndësishme të mbahet parasysh se neni 39, gërma ‘c’ e Ligjit për Profesionin e Avokatit në Republikën e Shqipërisë parashikon shprehimisht se: “c) Mosofrimi i shërbimeve të ndihmës juridike të garantuara nga shteti”, ku përfshihet mosofrimi në mënyrën e duhur i shërbimeve të ndihmës juridike për përfituesit e ndihmës juridike dytësore, sipas legjislacionit në fuqi për ndihmën juridike të garantuara nga shteti”, është shkak për fillimin e procedimit displinor të avokatit të përzgjedhur dhe të listuar për të dhënë ndihmë juridike falas.

ç) Parimi i cilësisë, efiçencës dhe efikasitetit në kosto për shërbimet e ofruara të ndihmës juridike

Në lidhje me parimin e parashikuar në nenin 4 pika ç) mbi cilësinë, efiçencën dhe efikasitetin në kosto për shërbimet e ofruara të ndihmës juridike, kujtojmë që Direktiva 2002/8/EC parashikon në nenin 3 ‘E drejta për ndihmë juridike’: “1. Personat fizikë të përfshirë në një mosmarrëveshje të mbuluar nga kjo Direktivë kanë të drejtë të marrin ndihmë juridike të përshtatshme në mënyrë që të sigurohet aksesi efektiv në drejtësi në përputhjeme kushtet e përcaktuara në këtë Direktivë. 2. Ndihma juridike konsiderohet e përshtatshme kur garanton: (a) këshilla paragjyqësore me qëllim arritjen e një zgjidhje para ngritjes së procedurave ligjore; (b) ndihma juridike dhe përfaqësimi në gjykatë, dhe përjashtimi nga, ose ndihma me, kostot e procedurave të marrësit te ndihmës, përfshirë kostot e përmendura në nenin 7 dhe tarifat për personat e ngarkuar nga gjykata për të kryer akte gjatë procedurës”. Në lidhje me këtë, është e rëndësishme të mbahet parasysh se neni 39, gërma ‘c’, e Ligjit për Profesionin e Avokatit në Republikën e Shqipërisë parashikon shprehimisht se: “c) Mosofrimi i shërbimeve të ndihmës juridike të garantuara nga shteti”, ku përfshihet mosofrimi në mënyrën e duhur i shërbimeve të ndihmës juridike për përfituesit e ndihmës juridike dytësore, sipas legjislacionit në fuqi për ndihmën juridike të garantuara nga shteti”, është shkak për fillimin e procedimit displinor të avokatit të përzgjedhur dhe të listuar për të dhënë ndihmë juridike falas.

d) Parimi i ruajtjes së konfidencialitetit

Parimi i ruajtjes së konfidencialitetit buron nga interesi më i mirë i personit që kërkon ndihmë juridike falas, është parim i rëndësishëm i shërbimeve të avokatëve (neni 10 i Ligjit për Profesionin e Avokatit në Republikën e Shqipërisë), si dhe buron nga dispozita të tjera ligjore përkatëse, si p.sh. Ligji për mbrojtjen e të dhënave personale”, neni 28 ‘Konfidencialiteti i të dhënave’: “Kontrolluesit, përpunuesit dhe personat, që vihen në dijeni me të dhënat e përpunuara, gjatë ushtrimit të funksioneve të tyre, detyrohen të ruajnë konfidencialitetin dhe besueshmërinë edhe pas përfundimit të funksionit. Këto të dhëna nuk përhapen, përveç rasteve të parashikuara me ligj”. Parimi i konfidencialitetit, mbi të gjitha, detyron avokatin të mos shpërndajë të dhënat personale të klientit të tij.

dh) Parimi i shmangies dhe parandalimit të konfliktit të interesit

Parimi i shmangies dhe parandalimit të konfliktit të interesit orientohet nga interesi më i mirë i kërkuesit të ndihmës juridike dhe është detyrim për t’u respektuar edhe në bazë të kërkesës përkatëse të parashikuar shprehimisht në Ligjin për Profesionin e Avokatit në Republikën e Shqipërisë (neni 9). Edhe neni 8 ‘Detyrat e Avokatit’, gërma ‘ç’, e këtij ligji, parashikon shprehimisht se avokati “ç) garanton mbrojtje ose përfaqësim transparent, në interesin më të mirë të klientit që përfaqëson, nëpërmjet parandalimit të konfliktit të interesit;...”.

e) Parimi i mbrojtjes së të drejtave të personave në nevojë

Ky parim i rëndësishëm duhet kuptuar që dhënia e ndihmës juridike, pavarësisht nga forma e ndihmës juridike, duhet të udhëhiqet vetëm nga mbrojtja e të drejtave të personave vulnerabël, kërkues të ndihmës juridike falas. Ky parim duhet lexuar në mënyrë të lidhur, veçanërisht, me parimin e besnikërisë ndaj klientit të parashikuar si parim i detyrueshëm për zbatim nga Ligji për Profesionin e Avokatit në Republikën e Shqipërisë[3] (neni 3). Edhe neni 8 ‘Detyrat e Avokatit’ gërma ‘ç’ e kёtij ligji, parashikon shprehimisht se avokati “ç) garanton mbrojtje ose përfaqësim transparent, në interesin më të mirë të klientit që përfaqëson, nëpërmjet parandalimit të konfliktit të interesit;...”. Parimi i besnikërisë i kërkon avokatit që në çdo shkallë të çështjes së tij të bëjë përpjekje vetëm në interes të klientit të tij, dhe nuk e lejon atë që në të ardhmen të mbrojë të drejtat dhe interesat e palës kundërshtare.

Në lidhje me këtë parim, përmendim orientimin përkatës të GJEDNJ mbi mundësinë e zgjedhjes nga përfituesi të avokatit të ndihmës juridike. Neni 6 (3) (c) i KEDNJ përcakton shprehimisht se: “Çdo i akuzuar për një vepër penale ka të drejtat minimale të mëposhtme: c. Të mbrohet vetë ose të ndihmohet nga një mbrojtës i zgjedhur prej tij, ose në qoftë se ai nuk ka mjete të mjaftueshme për të shpërblyer mbrojtësin, t’i mundësohet ndihma ligjore falas kur këtë e kërkojnë interesat e drejtësisë”. Leximi literal të orienton që avokati mund të zgjidhet në rastet kur nuk ofrohet ndihmë juridike. Pavarësisht nga kjo, GJEDNJ ka vendosur që personat të cilëve u jepet ndihmë juridike falas jo gjithmonë mund të zgjedhin avokatin. E drejta për t’u mbrojtur nga një avokat i zgjedhur mund të jetë subjekt i kufizimeve kur e kërkon Ligji. Në çështjen Croissant kundër Gjermanisё, GJEDNJ vlerësoi se dëshirat e aplikantit nuk duhet të injorohen por, duke marrë parasysh interesat e drejtësisë, zgjedhja e avokatit është e drejtё për shtetin[4]. Bazuar në sa më sipër, edhe në rastet kur përfituesi i ndihmës juridike nuk e ka zgjedhur vetë avokatin, parimi i ruajtjes së konfidencialitetit, i mbrojtjes së të drejtave të personave në nevojë, dhe të gjitha parimet e tjera, janë të zbatueshme me të njëjtën kërkesë si në rastin kur avokati zgjidhet sipas dëshirës së kërkuesit të ndihmës juridike.

Parimi i etikës detyron avokatin që gjatë veprimtarisë së tij të mos bëjë veprime ose mosveprime të cilat ulin figurën e avokatit dhe besimin e publikut në këtë profesion. Parimi i integritetit thërret që avokatët në detyrën e tyre të jenë të ndershëm dhe të vërtetë me klientët e tyre.

Kodi Etik i Avokatit është një tërësi rregullash të detyrueshme për avokatin, i cili miratohet me Vendim të Këshillit të Përgjithshëm të Dhomës së Avokatisë së Shqipërisë. Rëndësia e tij si një burim normash të detyrueshëm për avokatin rezulton nga pëmbajtja e nenit 8 të ligjit “Për Avokatinë” në të cilën parashikohet se Avokati, gjatë ushtrimit të profesionit, vepron në respekt të legjislacionit në fuqi, Statutit të Dhomës së Avokatisë të Shqipërisë, si dhe rregullave të Kodit Etik të Avokatit. Pra, Kodi Etik i Avokatit i miratuar me vendimin nr.31 datë 12.11.2005[5] të Këshillit Kombëtar të Avokatisë, vendoset përkrah ligjit në fuqi dhe Statutit të Dhomës së Avokatëve të Shqipërisë, duke i dhënë rregullave të tij fuqi detyruese të njëjtë me aktet e mëparshme, për sa kohë nuk vjen në kundërshtim me to. E njëjta frymë ligjore rezulton edhe nga përmbajtja e nenit 14 të Ligjit 55/2018 “Për Profesionin e Avokatit në Republikën e Shqipërisë”, sipas të cilit, një nga kushtet e ushtrimit të profesionit të avokatit është që ky të zbatojë dispozitat ligjore dhe ato të parashikuara në statut dhe në Kodin Etik të Avokatit.
