1. Shpenzimet për ndihmën juridike të garantuar nga shteti, në të gjitha format e saj, mbulohen nga buxheti i shtetit dhe nga burime të tjera të ligjshme.

2. Fondet për ndihmën juridike të garantuar nga shteti përbëjnë zë të veçantë në buxhetin e Ministrisë së Drejtësisë.

Të gjithё shpenzimet për ndihmën juridike, në formën e ndihmës juridike parësore, ndihmë juridike dytësore, përjashtim nga pagimi i tarifave gjyqësore dhe shpenzimeve gjyqësore, dhe përjashtim nga detyrimi për të parapaguar tarifën e vënies në ekzekutim të urdhrit të ekzekutimit përballohen nga buxheti i shtetit, përsa kohë sipas përcaktimeve të Kushtetutës dhe nenit 6 të Konvetës Evropiane për të Drejtat e Njeriut ndihma judike ndaj kategorive përfituese të saj, sipas kritereve të këtij ligji, është detyrim pozitiv i shtetit. Në shumë raste praktikat e bashkëpunimit mes institucioneve shtetëore dhe organziatave të shoqërisë civile në fushën e ndihmës juridike kanë qënë të suksesshme për të përballuar kërkesën e popullsisë për ndihmë juridike dhe njëkohësisht kursim dhe efikasitet të fondeve buxhetore të dedikuara për këtë qëllim.
