Detyrat e Ministrit të Drejtësisë

Neni:

Ministri i Drejtësisë ka përgjegjësitë dhe kryen detyrat e mëposhtme:

a) zhvillon politikën shtetërore në fushën e ndihmës juridike;

i propozon Ministrisë së Financave projektbuxhetin vjetor për ndihmën juridike, në përputhje me
rregullat e parashikuara në legjislacionin për menaxhimin e sistemit buxhetor;
mbikëqyr mirëfunksionimin e sistemit të ndihmës juridike dhe zbatimin e buxhetit vjetor për ndihmën juridike;

ç) raporton çdo vit në Kuvend për gjendjen e sistemit të ndihmës juridike;

miraton aktet e mëposhtme:

i) formularin e kërkesës për ndihmë juridike parësore;

ii) formularin e kërkesës për ndihmë juridike dytësore;

iii) formularin e kërkesës për përjashtim nga pagimi i tarifave gjyqësore dhe i shpenzimeve gjyqësore;

iv) formularin e vetëdeklarimit për ndihmë juridike parësore;

v) formularin e vetëdeklarimit të të ardhurave dhe të pasurive, sipas këtij ligji;

vi) formularin e vetëdeklarimit për kategoritë e veçanta, sipas nenit 11 të këtij ligji;

formatin e regjistrit për regjistrimin e kërkesave dhe vetëdeklarimeve të mësipërme;
formatin e regjistrit të organizatave jofitimprurëse që ofrojnë ndihmë juridike parësore;

ix) formularin e ankimit ndaj vendimit të rrëzimit të kërkesës për ndihmë juridike dytësore.

Ministria e Drejtësisë merr masat e nevojshme për publikimin e formularëve të parashikuar në këtë paragraf në format të aksesueshëm nga personat me aftësi të kufizuar;

dh) miraton krijimin e qendrave të shërbimit të ndihmës juridike parësore, pasi të ketë marrë më parë mendimin e Këshillit të Lartë Gjyqësor;

e) miraton kontratën tip me organizatat jofitimprurëse për shërbimet e ndihmës juridike parësore, sipas parashikimeve të këtij ligji, pasi të ketë marrë më parë mendimin e ministrisë përgjegjëse për financat;

ë) miraton kontratën tip me avokatët për dhënien e shërbimeve të ndihmës juridike dytësore;

f) miraton, pasi të ketë marrë më parë mendimin e Drejtorisë së Ndihmës Juridike Falas dhe Dhomës Kombëtare të Avokatisë, kriteret dhe metodologjinë për vlerësimin e cilësisë së ofrimit të shërbimeve të ndihmës juridike dhe procedurat e mbikëqyrjes nga Drejtoria e Ndihmës Juridike Falas të shërbimeve të ndihmës juridike;

g) miraton me udhëzim të përbashkët me ministrin përgjegjës për financat, pasi të ketë marrë më parë mendimin e Dhomës Kombëtare të Avokatisë, kriteret e përfitimit të pagesave dhe tarifat përkatëse të shpërblimit të avokatëve, të cilët ofrojnë shërbimet e ndihmës juridike dytësore;

gj) miraton procedurat që ndiqen nga Drejtoria e Ndihmës Juridike Falas në lidhje me pagesat për shpenzimet gjyqësore, sipas përcaktimeve të këtij ligji;

h) publikon listën e avokatëve që ofrojnë shërbimet e ndihmës juridike dytësore dhe listën e organizatave jofitimprurëse të autorizuara që ofrojnë shërbime të ndihmës juridike parësore në faqen zyrtare të Ministrisë së Drejtësisë;

i) miraton rregullat dhe procedurat për mbledhjen, plotësimin dhe administrimin e të dhënave të regjistrit të kërkesave dhe vetëdeklarimeve të subjekteve të këtij ligji dhe të regjistrit të organizatave jofitimprurëse që ofrojnë ndihmë juridike parësore;

j) kryen të gjitha detyrat e tjera të përcaktuara me këtë ligj.

Ky nen parashikon shprehimisht për detyrat dhe përgjegjësitë e Ministrit të Drejtësisë të cilat janë bazuar dhe duhet të zbatohen duke respektuar dispozitat ligjore përkatëse të parashikuara në Kushtetutën e Shqipërisë[1], Ligjin për Organizimin dhe Funksionimin e Këshillit të Ministrave[2], Ligj nr.8678, datë 14.5.2001 “Për organizimin dhe funksionimin e Ministrisë së Drejtësisë", i ndryshuar[3], Ligjin nr. 90/2012 “Për organizimin dhe funksionimin e administratës shtetërore”, dhe akte të tjera[4]. Veçanërisht, bazuar në nenin 6[5] të Ligjit nr. 9000/2003, në lidhje me ndihmën juridike, si detyra të Ministrit të Drejtësisë duhen kuptuar jo vetëm ato që parashikohen shprehimisht në Ligjin nr. 111/2017, por edhe ato që parashikohen në ligje të veçanta, si dhe ato që ngarkohen nga Këshilli i Ministrave dhe Kryeministri.

Në leximin e nenit 7 të Ligjit nr. 111/2017, duhen mbajtur parasysh edhe dallimi midis institucionit të Ministrit dhe Ministrisë përkatëse. Neni 7 i Ligjit “Për Organizimin dhe Funksionimin e Këshillit të Ministrave” parashikon se Ministria është personi juridik publik, që përfaqësohet dhe drejtohet nga Ministri dhe se Ministria mbështet, në aspektin teknik, veprimtarinë e Ministrit.

Në lidhje me detyrat që duhet të ushtrojë Ministri i Drejtësisë në fushën e ndihmës juridike edhe sipas nenit 7 të Ligjit nr. 111/2017, për qëllime të vlefshmërisë, hyrjes në fuqi dhe zbatueshmërisë të akteve përkatëse ligjore dhe nënligjore por edhe për qëllime të ndërhyrjeve përkatëse të Ministrit të Drejtësisë, duhet te zbatohen veçanёrisht dispozitat pёrkatёse tё Kushtetutёs sё Republikës së Shqipërisë, si neni 80[6], neni 100[7], neni 104[8], neni 116[9], neni 119[10].

Ky nen duhet të lexohet se ai përcakton jo vetëm detyrat dhe përgjegjësitë e Ministrit të Drejtësisë në fushën e ndihmës juridike, por edhe përcakton disa nga aktet nënligjore të cilat duhet të miratohen në zbatim të Ligjit nr. 111/2017.

Në bazë të nenit 7 të Ligjit nr. 111/2017, detyrat dhe përgjegjësitë e Ministrit të Drejtësisë në fushën e shërbimit të ndihmës juridike përmblidhen si vijon: zhvillon politikën shtetërore për të siguruar akses efektiv në sistemin e drejtësisë për shërbimin e ndihmës juridike, përgatit projektbuxhetin në përputhje me legjislacionin në fuqi, ngre Drejtorinë për Ndihmën Juridike Falas në varësi të saj, mbikëqyr zbatimin e dispozitave ligjore e nënligjore dhe ndihmon në vlerësimin e cilësisë së ndihmës juridike të dhënë, i propozon Dhomës Kombëtare të Avokatisë, në rast të shkeljes së dispozitave të ligjit, fillimin e procedimit disiplinor për marrjen e masave të pezullimit ose heqjes së lejes së ushtrimit të profesionit të avokatit[11].

Në lidhje me detyrat dhe përgjegjësitë e Ministrit të Drejtësisë të përcaktuara në nenin 7 pika ‘a’, kjo dispozitë duhet lexuar jo vetëm si detyrim i Ministrit në lidhje me zhvillimin e politikave përkatëse, e përcaktuar kjo edhe në nenin 5 ‘Misioni i Ministrisë së Drejtësisë’ të Ligjit për organizimin dhe funksionimin e Ministrisë së Drejtësisë, por edhe me hartimin e strategjive afatshkurtra, afatmesme dhe afatgjatë që kanë të bëjnë me ndihmën juridike. Hartimi dhe më pas miratimi njëkohësisht i politikave dhe strategjive përkatëse nga Këshilli i Ministrave në lidhje me ndihmën juridike është një detyrim i cili është zbatuar tashmë në këtë mënyrë të njëkohëshme nga Ministri i Drejtësisë. Vetëm për qëllime të të kuptuarit të gërmёs përkatëse ‘a’ të nenit në fjalë, vlen të përmendet edhe hartimi dhe miratimi i strategjisë ndërsektoriale të drejtësisë 2017-2020 dhe të planit tё saj veprimit[12] i cili për qëllime të objektivit 3 të saj “Përmirësimi i funksionimit të sistemit gjyqësor duke forcuar efektivitetin, transparencën dhe qasjen në pajtim me standardet evropiane” ka miratuar edhe strategjinë dhe planin e veprimit në fushën e ndihmës juridike. Strategjia ndërsektoriale e drejtësisë që do të miratohet për vitet në vazhdim dhe planet e veprimit përkatës duhet të konsiderohen dhe zbatohen.

Në lidhje me detyrat dhe përgjegjësitë e Ministrit të Drejtësisë të përcaktuara në nenin 7 pika ‘b’, buxheti për ndihmën juridike duhet të propozohet dhe të ndiqet deri në miratim në përputhje me legjislacionin përkatës për procedurën e buxhetimit shtetëror dhe, mbi të gjitha, në Ligjin “Për organizimin dhe funksionimin e Ministrisë së Drejtesise” dhe Ligjin nr. 9936, datë 26.6.2008 “Për menaxhimin e sistemit buxhetor në Republikën e Shqipërisë”, i ndryshuar[13], veçanërisht nenet 22 deri 31 të këtij të fundit.

Zërat që duhen propozuar në buxhetim në lidhje me ndihmën juridike, duhet të kenë të bëjnë me zëra të tillë, si pagat, shpërblime, sigurime shoqërore e shëndetsore për punonjësit në strukturat përkatëse që japin ndihmë juridike parësore, personel administrativ në Drejtorinë e Ndihmës Juridike, qendrat, etj., por edhe shpenzime në lidhje me avokatët që do të kontraktohen në vite, të caktuar për dhënien e ndihmës juridike dytësore. Po kështu, kujdes duhet kushtuar gjatë buxhetimit për shpenzimet gjyqësore, përfshirë tarifat gjyqësore, që mundësojnë ofrimin e shërbimeve efektive të ndihmës juridike. Për aq sa mund të jetë a zbatueshme në lidhje me Ligjin nr. 111/2017, kujtojmë se neni 147/a i Kushtetutës së Republikës së Shqipërisë parashikon se Ministri i Drejtësisë mund të marrë pjesë, pa të drejtë vote, në mbledhjet e Këshillit të Lartë Gjyqësor kur diskutohen çështje që lidhen me planifikimin strategjik dhe buxhetin e pushtetit gjyqësor.

Në lidhje me detyrimet e përcaktuar në nenit 7 pikat ‘d’ deri ‘k’ të Ligjit nr. 111/2017, Ministri duhet të miratojë aktet nënligjore sipas përcaktimeve përkatëse të Ligjit nr. 111/2017. Në zbatim të këtij neni, deri në datën e këtij Komentari, Ministri i Drejtësisë ka miratuar aktet e rradhitura shprehimisht në seksionin “Hyrje” të këtij Komentari.

Kryerja e detyrave sipas gërmës ‘d’ dhe të tjera përkatëse të këtij neni 7, duhet përmbushur nga Ministri i Drejtesisë duke konsideruar edhe udhëzimet përkatëse të parashikuara nga Direktiva 2002/8/EC, veçanërisht neni 13/2[14] dhe 16: formularët duhet të jenë në gjuhën shqipe zyrtare dhe, në kushtet që ndihma juridike duhet të jepet edhe të huajve, formularët duhen të jenë të gatshme edhe në gjuhën angleze, si një nga gjuhët zyrtare të BE, formularët duhet të kenë kërkesa të qarta në lidhje me dokumentet e nevojshme që duhet t’i bashkëngjiten formulareve, kur është e zbatueshme, të mos kenë nevojë për legalizim ose formalitet ekuivalent, dhe për të lehtësuar aplikimet dhe për transmetimin e këtyre aplikimeve duhet të krijohet një formë standarde për ndihmën juridike dhe një procedurë e mirëpërcaktuar. Pa kundërshtuar sa më sipër, detyrat e Ministrisë së Drejtësisë në lidhje me ndihmën juridike janë përcaktuar jo vetëm në Ligjin nr. 111/2017 dhe në aktet nënligjore përkatëse, por edhe në legjislacionin tjetër përkatës. Kështu, Ligji nr. 9669, datë 18.12.2006 “Për masa ndaj dhunës në marrëdhënie familjare”, i ndryshuar, neni 7 ‘Detyrat e autoriteteve përgjegjëse të linjës’ parashikon shprehimisht “...3. Ministria përgjegjëse për drejtësinë ka këto detyra: ...c) mbikëqyr funksionimin e sistemit të ofrimit të ndihmës juridike për viktimat e dhunës në familje, sipas rregullave të përcaktuara nga legjislacioni në fuqi për ndihmën juridike të garantuar ngashteti;...”. Në veçanti, këto akte të tjera duhen konsultuar veçanërisht në funksion të detyrës së Ministrit për të monitoruar cilësinë e ofrimit të ndihmës juridike, në kushtet që dispozitat përkatëse në ligje të tjera parashikojnë detyra specifike në lidhje me zbatimin e ligjit përkatës.

When I initially commented I clicked the "Notify me when new comments are added"
checkbox and now each time a comment is added I get several emails with the
same comment. Is there any way you can remove me
