Kërkesa për ndihmë juridike dytësore
Kërkesa për dhënien e ndihmës juridike dytësore paraqitet nga personi i interesuar personalisht ose me anë të shërbimit postar pranë gjykatës ose organit procedues që fillon hetimet, përpara fillimit të një procesi gjyqësor, në fillim të një procesi gjyqësor dhe/ose në çdo fazë të procesit gjyqësor, derisa nuk është deklaruar i mbyllur hetimi gjyqësor, sipas rregullave të parashikuara në legjislacionin procedural.
Personi që gëzon të drejtën për ndihmë juridike dytësore, mund ta paraqesë kërkesën e parashikuar në pikën 1, të këtij neni, nëpërmjet një përfaqësuesi ligjor apo të pajisur me prokurë, ose nëpërmjet bashkëshortit/es, bashkëjetuesit/es ose një të afërmi të shkallës së parë.
Kërkesa për ndihmë juridike dytësore përjashtohet nga tarifat dhe shpenzimet gjyqësore.
Personi, i cili kërkon të përfitojë ndihmë juridike dytësore, nënshkruan një vetëdeklarim se përmbush kriteret e përfitimit, të përcaktuara në këtë ligj, sipas formularit të vetëdeklarimit të miratuar nga Ministri i Drejtësisë, të shoqëruar me dokumentacionin justifikues. Lista e dokumenteve që shërbejnë për vërtetimin e përmbushjes së kritereve përcaktohet me urdhër të Ministrit të Drejtësisë.
Dispozita e mësipërme paraqet modalitetet e paraqitjes së kërkesës për dhënien e ndihmës juridike dytësore. Kërkesa, siç parashikohet në 18, realizohet nëpëmjet një formulari, i cili paraqitet në gjykatë nga personi i interesuar personalisht apo edhe nëpërmjet shërbimit postar. Kërkesa nënshkruhet nga vetë personi apo përfaqësuesi i tij ligjor, përfaqësues me prokurë apo bashkëshorti/bashkëjetuesi apo apo fëmijët e përfituesit të ndihmës juridike dytësore.
Në paragrafin 3 të kësaj dispozite paraqitet fjala “shpenzimet“; është e paqartë se çfarë ka pasur parasysh Ligjvënësi me fjalën shpenzime gjyqësore dhe cili mund të jetë rrethi i situatave konkrete kur për kërkesën për ndihmë juridike dytësore nuk duhet të kryhen shpenzime gjyqësore, sipas përcaktimit që i bëjnë konceptit të shpenzimeve ligjet përkatëse proceduriale.
Në rast se procesi gjyqësor ka nisur, kërkesa për ndihmën juridike dytësore paraqitet tek i njëjti gjyqtar apo kërkesa depozitohet në sekretari dhe gjyqtari që e shqyrton atë caktohet me short? Në disa raste të paraqitjes së kërkesës për ndihmën juridike dytësore, kërkesa mund të paraqitet edhe veçmas. Psh për të hartuar kërkesë padinë personi që plotëson kushtet për të përfituar ndihmën juridike dytësore ka nevojë për asistencën e një avokati, ndaj edhe kërkesa paraqitet para depozitimit të kërkesëpadisë. Në rast se, për ndonjë arsye, procesi gjyqësor ka filluar atëherë është e këshillueshme që kërkesa për ndihmën juridike dytësore të paraqitet për vendimmarrje tek i njëjti gjyqtar që ka filluar shqyrtimin e çështjes, qoftë edhe në fazën e veprimeve përgatitore të kërkesë padisë.
Nisur nga praktika e deritanishme dhe me qëllim unifikimin e procedurës që duhet të ndiqet në të gjithë gjykatat është e nevojshme hartimi i një metodologjie sesi shqyrtohet kërkesa për ndihmën juridike dytësore, kur ajo paraqitet para hartimit të kërkesë padisë apo sipas rastit deklaratës së mbrojtjes, gjatë shqyrtimit gjyqësor të një kërkesëpadie deri në mbylljen e hetimit gjyqësor në gjykatë.
“Kërkesa për dhënien e ndihmës juridike dytësore paraqitet ..nga personi i interesuar personalisht ose me anë të shërbimit postar pranë organit procedues që fillon hetimet...,.” Situata juridike e parashikuar në këtë nen është e ndryshme nga ajo që parashikohet në nenin 21 të ligjit kur përfituesi i ndihmës juridike dytësore që fillon merr statusin e të pandehurit.
Edhe personi që është nën hetim, sipas përcaktimeve që bën Kodi i Procedurës Penale, në rastet kur përmbush kërkesat e parashikuara në këtë ligj, është përfitues i ndihmës juridike dytësore. Në çështjen Salduz v Turqisë, vendim i Dhomës së Madhe të Gjykatës Europiane për të Drejtat e Njeriut, theksohet se: “Në këtë drejtim, Gjykata nënvizon rëndësinë e fazës së hetimit për përgatitjen e procedimit penal, pasi provat e marra gjatë kësaj faze përcaktojnë kornizën në të cilën vepra e ngarkuar do të shqyrtohet në gjykim (shih Can v. Austrisë, nr. 9300/81, raport i Komisionit i 12 korrikut 1984, § 50, Seria A nr. 96). Në të njëjtën kohë, i akuzuari shpesh e gjen veten në një pozitë veçanërisht vunerabël në atë fazë të procedurës, efekti i tij është i shumëfishuar me faktin se legjislacioni mbi procedurën penale ka tendencë të bëhet gjithnjë e më kompleks, veçanërisht duke respektuar rregullat që përcaktojnë mbledhjen dhe përdorimin e provave. 55. Përkundër këtij sfondi, Gjykata konstaton që në mënyrë që e drejta për një gjykim të drejtë të mbetet mjaftueshëm "praktike dhe efektive", neni 6 § 1 kërkon që, si rregull, aksesi tek një avokat duhet të sigurohet që nga marrja më e parë në pyetje e një të dyshuari nga policia, përveç nëse dëshmohet në dritën e rrethanave të veçanta të secilit rast se ekzistojnë arsye bindëse për të kufizuar këtë të drejtë. Edhe kur arsyet bindëse mund të justifikojnë në mënyrë të jashtëzakonshme mohimin e aksesit tek një avokat, një kufizim i tillë – cilido qoftë arsyetim i tij - nuk duhet të paragjykojë padrejtësisht të drejtat e të akuzuarit sipas nenit 6 (shiko, mutatis mutandis, Magee, cituar më lart, 44 §). Të drejtat e mbrojtjes, në parim, paragjykohen në mënyrë të pakthyeshme, kur deklaratat inkriminuese të bëra gjatë marrjes në pyetje të policisë pa aksesin tek avokati janë përdorur për një dënim.”
Në çështjen Aleksand Zaichenko v Rusisë, Gjykata Europiane e të Drejtave të Njeriut ka theksuar se: “54. Duke pasur parasysh konceptin e drejtësisë në nenin 6, Gjykata konsideron se e drejta për të mos inkriminuar veten, në mënyrë të arsyeshme, nuk mund të kufizohet në deklaratat e pranimit të veprimeve keqbërëse ose në vërejtje që janë drejtpërdrejt inkriminuese (shiko Saunders, cituar më lart, § 71). Dëshmia e marrë nën detyrim, e cila paraqitet në pamjen e saj të një natyre jo-inkriminuese - siç janë vërejtjet ngacmuese ose informacione të thjeshta për çështje faktike - më vonë mund të vendosen në procedimet penale në mbështetje të çështjes penale, për shembull për të kundërshtuar ose hedhur dyshime mbi deklaratat e tjera të të akuzuarit ose provave të dhëna prej tij gjatë gjykimit ose ndryshe te nënvlerësojnë besueshmërinë e tij (po aty).”
Neni 109, paragrafi 3 i ligjit nr. 108/2014 “Për Policinë e Shtetit” përcakton se: “3. Personi i shoqëruar ka të drejtë të njoftohet menjëherë në gjuhën që ai kupton, për shkaqet e shoqërimit. Ai/ajo duhet të njoftohet se nuk ka asnjë detyrim të bëjë ndonjë deklaratë dhe ka të drejtë të komunikojë menjëherë me një person të besuar dhe avokatin.”
Ndërkohë sipas nenit 6, “Shoqërimi” është dërgimi i shtetasit në ambientet e policisë, në institucionet shëndetësore, në qendrat e rehabilitimit, te kujdestari ose personi përgjegjës, në institucionin urdhërdhënës ose në institucionet e tjera me ose pa vullnetin e tij, sipas përcaktimeve të bëra në nenet 109 dhe 122, pika 1, të këtij ligji.”
Neni 19 në situatën juridike që parashikon përcakton se ndihma juridike dytësore është e detyrueshme të ofrohet për personin që plotëson kushtet për ta përfituar atë, që nga momenti i shoqërimit deri në momentin (nëse vijojnë hetimet) kur personi merr statusin e të pandehurit sipas Kodit të Procedurës Penale. Kjo fazë, pra ofrimi i ndihmës juridike dytësore nga momenti i shoqërimit të personit në Policinë e Shtetit, rezulton se është i pambuluar në kuptimin normativ nga asnjë akt nënligjor, i nxjerrë deri më tani në zbatim të ligjit “Për ndihmën juridike të garantuar nga shteti”. Është e nevojshme që për zbatimin e plotë të ligjit për të cilit bëhet ky komentar, juridsprudencës së Gjykatës Europiane për të Drejtat e Njeriut dhe vetë përcaktimit të ligjit “Për Policinë e Shtetit”, Ministri i Drejtësisë, Ministri i Brendshëm dhe Prokurori i Përgjithshëm të hartojnë një akt të përbashkët nënligjor për të rregulluar çështjen e ofrimit të ndihmës juridike dytësore për personat (që plotësojnë kushtet) që nga faza e shoqërimit të tij në Policinë e Shtetit dhe më tej kur është përson nën hetim, deri në momentin e marrjes si i pandehur, sipas Kodit të Procedurës Penale.
